In 2013, the PoSH Act came into effect following a protracted process of court rulings and public pressure. The POSH Act, which was passed ten years ago, was intended to give women in both the public and private sectors secure working environments. Nonetheless, the establishment of a safe workplace and the POSH regulations’ implementation are a long way away for women’s safety in India’s workplaces, as per the Walchand Plus Report.
In a groundbreaking evaluation of the corporate sector’s application of the Prevention of Sexual Harassment (POSH) Act, research partner BDB India and workplace solutions leader Walchand Plus (a division of Walchand People First Itd., which also owns the Dale Carnegie business in India) uncover crucial flaws that prevent the establishment of a safe environment for women to work. This thorough investigation, carried out in November 2023, highlights the critical requirement for a revolutionary strategy to guarantee worker safety.
The study reveals a concerning finding: forty percent of working women who are facing insecurity are not aware of the POSH Act’s protective provisions. The research indicates that employees are not fully aware of the Act’s requirements, which emphasizes the need for more education on the subject. Remarkably, just 42% of workers are fully cognizant of the POSH Act.

The paper also debunks common assumptions held by organizations, where adhering to the Act is frequently viewed as a box to be checked rather than as a sincere effort to provide a safe space for women. According to surveys, 53% of HR professionals don’t understand the Act. The study also revealed that HR managers worry about senior management’s propensity to minimize harassment complaints and women’s underrepresentation.
Pallavi Jha, the Managing Director and Chairperson of Walchand PeopleFirst, commented on the findings, saying, “As a woman, I feel India still has a long way to go when it comes to bridging the gender disparity.” “Although our society is still mostly patriarchal, Walchand Plus is dedicated to promoting positive change and cultivating a climate of safety, inclusivity, and respect in Indian workplaces.”
“Understanding the problem with recent data, which is what we have attempted to achieve with our study paper, is the first step towards achieving that. It ought to be common sense for employers to protect women at work, but sadly, many of them only give it surface attention. Walchand Plus thinks that businesses may make a big difference in the dynamics of the workplace by implementing safety measures that protect each employee’s health and safety.”
The study shows that there is still room for improvement in the application and compliance with the POSH Act due to a number of limitations, including the underrepresentation of senior women on Internal Complaints Committees (ICCs). The study emphasizes how important it is to provide training that addresses procedural issues, promotes a preventive culture, and goes beyond legal knowledge.
